Set out below are the terms and conditions which apply to the goods offered by Gallery66 on our website. These terms and conditions do not affect your statutory rights.

Descriptions & Representations
As part of our commitment to our customers, we have made every effort to display and describe the products featured on our website as accurately as possible. This website contains many items that are hand-made, not produced in factories by machines, and as such there may be slight, normal variations between each item - these will not affect the quality of the items in any way. If you would like more information about these variations, please contact us.

We are confident that the colours you see will be a good represenation of the actual items, but please bear in mind that different computer screens represent colours differently due to brightness, contrast and ambient lighting.

Where items you have ordered are not available, we will contact you to discuss this. Prices may be subject to change, although we will notify you if items you request from us have changed in price.

Our Website, Marketing and Your Information
Our website provides a facility for you to make an offer to us, which we will then acknowledge and then fulfil subject to accepting the offer. Receiving your payment does not constitute acceptance of your order, and it may be returned to you if your order is not accepted.

We retain information collected when you place your order, and may use this information discretely, for marketing purposes. We do not share this information with any third party for marketing purposes. If you would not like to receive any information from us, or if you would like to see the data we have collected, please write to us at customerservice@gallery66.com.

Property and Payment
All goods remain our property until full payment has been received. If goods are delivered and we have not been notified in writing of any shortages, errors or damage within 7 working days of the goods being delivered to you, the cost of goods and delivery charges is payable by you to us. If payment is not received within 14 days of delivery, we reserve the right to recover the goods at your expense, and if they damaged or unsellable we may recover the entire cost of the goods themselves.

You may not withhold payment of any sum due to us for goods delivered to you in accordance with your order, for any reason, as an excercise of any right of set off or counterclaim which you may have or allege to have or for any other reason, whatsoever.

Your Right to Cancel
After receiving items from us, you have seven working days within which to notify us in writing that you wish to cancel your order and return the items. Custom-made items cannot be returned to us. Please read the following section about returning items to us.

Delivery & Returns
We attempt to deliver all items within 28 days of receiving your order, however in some circumstances it may take longer than this to deliver goods to you. We will endeavour to notify you of any delay, if we consider such notification to be appropriate. However we shall not be liable for any loss or damage whatsoever due to failure by us to deliver the goods within 28 days.

It is your responsibility to check items that are delivered to you and inform us of any shortages, errors or damage within 7 working days of delivery. Outside this period it is at our discretion to enter into any claims relating to your order. This may incur fees, though we will set these out to you in advance of them being incurred.

If, for any circumstances, goods are accepted by us for return it is your responsibility to pay for their return and to ensure that they reach us safely, and we recommend that you use an insured service to cover the eventuality of in-transit damage. Only once the goods have been inspected by us will we entertain refunding delivery charges. If goodwill exceptions are made to this specific rule, they shall not constitute waiver of our rights or a change in policy.

Liability
Our liability to you for any breach of contract or negligence (save and except our liability for negligence for death or personal injury) shall be limited to the price of the goods together with any expenses incurred by you in notifying us and returning the goods to us.

We shall not be liable for any consequential loss including without limitation any loss caused by interruption of your business, loss of electronic information or physical damage to property and whether directly or indirectly caused by any breach of contract or by negligence by us or by any servant or agent of ours.

Jurisdiction & Governing Law
This contract is subject to the law of England and Wales. All disputes arising out of this agreement or associated business shall be subject to the exclusive jurisdiction of the courts of England and Wales.

We would like to draw your attention to the Distance Selling Regulations

If any part of these terms and conditions shall be found to be unlawful, it shall not affect the validity or enforceability of the remainder of the conditions.
